The United States Citizenship and Immigration Services (USCIS) offers protection to those who fear political, race, nationality, religious, or social persecution in their native country under two basic sets of laws: refugee law and asylum law.  The petitioner must demonstrate a "well-founded fear of persecution" in their native country.

 

Individuals applying for relief while entering, or residing in the United States of America, even surreptitiously, are asylum applicants.  Refugee applicants apply for protection while outside the United States, and before departing for the United States.
