MEDICAL EMPLOYMENT

The H-1B and EB-3 visa categories require the Medical Professional to either pass the Commission on Graduates of Foreign Nursing Schools (CGFNS) examination or have a valid United States nursing license. 

Both the H-1B and EB-3 categories have a maximum number of visas that can be issued each year.  The CGFNS examination appraises the Medical Professional’s probability of success on the National Council Licensure Examination for Registered Nurses (NCLEX-RN) licensing examination. 

The NCLEX-RN is the examination that registered nurses are required to pass in order to obtain a nursing license in the United States.  Medical Professionals must obtain a VisaScreen certification, issued by the International Commission on Healthcare Professionals (ICHP) in order to qualify for both the H-1B and EB-3 visa categories.

The VisaScreen certification consists of an educational analysis of the Medical Professional, foreign licensure validation, English language proficiency verification and a review of either the CGFNS or NCLEX-RN examination results. 

Medical Professionals are require to pass the CGFNS examination prior to taking the NCLEX-RN examination in the following states: Alabama, Alaska, Arizona, Arkansas, Colorado, Connecticut, District of Columbia, Florida, Georgia, Hawaii, Idaho, Indiana, Iowa, Kansas, Kentucky, Louisiana, Maine, Maryland, Massachusetts, Michigan, Minnesota, Missouri, Montana, Nebraska, Nevada, New Hampshire, New Jersey, North Carolina, North Dakota, Oklahoma, Pennsylvania, Rhode Island, South Carolina, South Dakota, Texas, Vermont, Virginia, Washington, West Virginia and Wyoming.

United States employers may petition with United States Citizenship and Immigration Services (USCIS) for the Medical Professional utilizing either a non-immigrant (H-1B temporary worker) or immigrant (EB-3 permanent worker) visa categories.  Both the H-1B and EB-3 categories have a maximum number of visas that can be issued each year.
